Terms of Service for Rubbish Collection Swiss Cottage

These Terms and Conditions set out the basis on which we provide rubbish collection and related waste removal services in and around Swiss Cottage. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Customer means the individual, business, landlord, agent or organisation requesting rubbish collection or associated services.

Company means the provider of rubbish collection and waste removal services trading as Rubbish Collection Swiss Cottage.

Services means any rubbish collection, waste clearance, bulky item removal, recycling, loading, labour, or related work undertaken by the Company.

Premises means the property, building, site or location where the Services are to be carried out.

Waste means any rubbish, refuse, unwanted items, recyclable materials, furniture, appliances or other material agreed to be collected under the Services, excluding any prohibited or hazardous waste.

2. Scope of Services

The Company provides domestic and commercial rubbish collection and waste removal services within a defined service area that includes Swiss Cottage and surrounding neighbourhoods. The exact Services to be provided will be described in the quotation or booking confirmation supplied to the Customer.

The Company will use reasonable care and skill in providing the Services and will carry out collections within agreed time windows wherever possible. Time is not of the essence and collection times may vary due to traffic, access issues, weather conditions or operational reasons.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form, or in writing, subject to the Companys availability and confirmation.

3.2 The Customer must provide accurate information about the Premises, access arrangements, the type and approximate volume or weight of Waste, any items requiring special handling, and any relevant parking or loading restrictions.

3.3 Based on the information provided, the Company may offer either a fixed price quotation or an estimate. Where an estimate is given, the final price may vary depending on the actual volume, weight, nature of the Waste and the time or labour required.

3.4 A booking is accepted and a contract is formed when the Company confirms the booking and, where applicable, receives any required deposit or pre-payment from the Customer.

3.5 The Company reserves the right to refuse any booking at its absolute discretion, including where the Waste is suspected to be hazardous, access is unsafe, or the requested work falls outside the Companys operational capacity.

4. Pricing and Quotations

4.1 Prices are generally based on one or more of the following: the volume of Waste, the weight of Waste, the type of Waste, the labour required, access conditions and any disposal or recycling fees.

4.2 All quotations are given in good faith based on the information supplied by the Customer and are subject to change if that information is inaccurate or incomplete, or if the actual Waste or conditions at the Premises differ significantly from those described.

4.3 The Company will inform the Customer as soon as reasonably practicable if any change to the quoted price is necessary. If the Customer does not accept the revised price, the Company may cancel the booking and no Services will be carried out. In such circumstances, the Customer may be liable for a call-out or attendance charge if the Company has already travelled to the Premises.

4.4 Unless otherwise stated, prices are exclusive of any applicable taxes that may be chargeable under UK law.

5. Payments

5.1 Payment terms will be stated at the time of booking. In most cases, payment is due in full on completion of the Services or in advance for certain types of bookings.

5.2 The Company accepts payment by cash, debit card, credit card, bank transfer, or other methods as notified to the Customer at the time of booking.

5.3 For business Customers, the Company may, at its discretion, agree to provide Services on account. In such cases, payment must be made in accordance with the agreed credit terms. If no specific terms are agreed, payment is due within 14 days of the invoice date.

5.4 The Company reserves the right to charge interest on overdue amounts at the statutory rate permitted under UK law, accruing from the due date until the date of actual payment, whether before or after judgment.

5.5 The Customer is responsible for all reasonable costs and expenses incurred by the Company in pursuing unpaid sums, including legal and debt collection costs.

6. Cancellations and Amendments

6.1 If the Customer wishes to cancel or amend a booking, they must notify the Company as soon as possible by telephone or email.

6.2 For standard bookings, the Customer may cancel without charge if at least 24 hours notice is given before the agreed arrival time. Cancellations made with less than 24 hours notice may incur a cancellation fee or a call-out charge at the Companys discretion.

6.3 For same-day bookings or special services, shorter notice periods may apply, and cancellation charges may be higher due to the resources reserved for the job.

6.4 If the Customer is not present at the Premises at the agreed time, or if access cannot be obtained despite reasonable efforts by the Company, the booking may be treated as a late cancellation and a fee may be charged.

6.5 The Company reserves the right to cancel or reschedule a booking in the event of circumstances beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, accidents, road closures, staff illness, or safety concerns at the Premises. In such cases, the Company will endeavour to arrange an alternative appointment as soon as reasonably practical.

7. Customer Obligations and Access

7.1 The Customer must ensure that the Companys operatives have safe, reasonable and unobstructed access to the Premises and to the Waste to be collected, including appropriate parking and loading arrangements.

7.2 The Customer is responsible for obtaining any necessary permits, authorisations or consents for parking, access into controlled areas or use of shared spaces. Any fines or penalties arising from incorrect information or failure to secure authorisation may be charged to the Customer.

7.3 The Customer must ensure that the Waste intended for collection is clearly identified and separated from items that are not to be removed. The Company is not responsible for the accidental removal of items that are not clearly distinguished from Waste.

7.4 The Customer must inform the Company in advance of any items that are particularly heavy, fragile, oversized, or that may require special lifting or dismantling. The Company may refuse to handle items that present an unacceptable risk to health and safety.

8. Prohibited and Restricted Waste

8.1 The Company operates in accordance with UK waste regulations and cannot collect certain types of waste, including but not limited to: asbestos, clinical or medical waste, chemical waste, corrosive substances, explosives, gas cylinders, pressurised containers, paints, oils, solvents, and other hazardous or dangerous materials.

8.2 If prohibited or restricted waste is discovered during the collection, the Company may refuse to remove it and may also decline to remove any associated Waste where it would be unsafe or unlawful to do so.

8.3 If the Customer has misdescribed the nature of the Waste and this results in additional costs, delays or regulatory issues for the Company, the Customer will be responsible for any reasonable associated charges, including additional handling, storage, or disposal fees.

9. Waste Handling and Disposal

9.1 The Company is committed to managing Waste responsibly and, where possible, will prioritise recycling and recovery over disposal. However, no guarantee is given that any particular item or material will be recycled.

9.2 Once Waste has been collected and loaded onto the Companys vehicle, legal ownership of the Waste transfers to the Company, and the Customer relinquishes any rights or claims over it.

9.3 The Company will transport and dispose of Waste at authorised facilities in accordance with applicable UK laws and regulations. The Company will maintain appropriate records, licences and permits for the carriage and transfer of controlled waste.

10. Liability and Insurance

10.1 The Company will exercise reasonable care when carrying out the Services. However, the Companys liability for any loss or damage arising from the Services is limited as set out in this clause.

10.2 The Company will not be liable for any pre-existing damage to the Premises or to items on the Premises, nor for wear and tear consistent with normal use.

10.3 The Company will not be responsible for loss or damage resulting from inadequate or unsafe access, structural defects, hidden obstacles, or where the Customer has required the operatives to perform tasks that, in the Companys reasonable opinion, carry a higher risk of damage.

10.4 To the fullest extent permitted by law, the Company excludes liability for indirect or consequential losses, loss of profit, loss of business, loss of goodwill, or loss of opportunity arising out of or in connection with the Services.

10.5 In any event, the total liability of the Company for any claim arising under or in connection with the provision of the Services, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total price paid or payable by the Customer for the specific Services to which the claim relates.

10.6 Nothing in these Terms and Conditions shall exclude or limit the Companys liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter where such exclusion or limitation is not permitted by law.

11. Damage and Complaints

11.1 Any alleged damage to property or items, or dissatisfaction with the Services, must be reported to the Company as soon as reasonably practicable and in any event within 48 hours of completion of the Services.

11.2 The Customer must provide reasonable evidence of any alleged damage or issue, including photographs and a clear description of the circumstances. The Company may inspect the Premises or items concerned before agreeing any remedy.

11.3 Where the Company accepts responsibility, it may at its discretion offer to repair the damage, replace the item on a like-for-like basis, or provide a reasonable financial compensation up to the limits set out in these Terms and Conditions.

12. Health and Safety

12.1 The Company is committed to operating safely and in compliance with health and safety legislation. The operatives may refuse to undertake any activity that, in their reasonable judgment, presents a risk to health, safety or property.

12.2 The Customer must not require the operatives to lift items beyond safe manual handling limits, to work at unsafe heights, or to enter confined spaces or other hazardous areas.

12.3 If an unsafe condition is identified at the Premises, the Company may suspend or cancel the Services until the issue is resolved. The Customer may be liable for any reasonable attendance charge incurred.

13. Data Protection and Privacy

13.1 The Company will collect and process personal information supplied by the Customer for the purposes of delivering the Services, handling payments, managing bookings and, where agreed, providing information about related services.

13.2 The Company will take reasonable steps to protect personal information in accordance with applicable UK data protection laws and will not sell personal data to third parties.

14. Force Majeure

14.1 The Company shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include, but are not limited to, extreme weather, natural disasters, acts of government, industrial disputes, transport disruptions, or utility failures.

15. Variation of Terms

15.1 The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customers booking will apply to that booking.

15.2 Any variation to these Terms and Conditions requested by the Customer will only be valid if agreed in writing by an authorised representative of the Company.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their formation.

17. Severability

17.1 If any provision or part-provision of these Terms and Conditions is or becomes invalid, unlawful or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of the Terms and Conditions.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any prior agreements, understandings or arrangements, whether written or oral.

By proceeding with a booking for rubbish collection or related services with Rubbish Collection Swiss Cottage, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
